Our Privacy Policy was updated on 1 October 2019. We have revised the Privacy Policy so that from this date onwards, this Privacy Policy can provide privacy details on how we manage your personal information for Mi TV Remote Control Plugin and services.

This Privacy Policy describes how Beijing Xiaomi Electronics Co., Ltd. and its affiliates (hereinafter referred to as "Xiaomi", "we", "our" or "us") collects, uses, discloses, processes, and safeguards the information you provide to us when you are using our products or services. If we ask you to provide certain information in order to verify your identity when you are using Mi TV Remote Control Plugin or services, we will use this information in strict accordance with this Privacy Policy and/or our User Terms and Conditions.

This Privacy Policy was formulated to fully take your needs into account. It is important that you fully understand our personal data collection and usage practices and feel confident in your ability to control the personal information you provide to Xiaomi.

In this Privacy Policy, "personal information" refers to data, either derived from information itself or from other related personal information that Xiaomi is able to access, that can distinguish a specific individual.

By using Xiaomi products and services, it shall indicate that you have read, acknowledged, and accepted all terms found in this Privacy Policy and any changes we may introduce at any time. We pledge to protect the privacy, confidentiality, and safety of your personal information by following applicable laws (including your local data protection laws). At the same time, we also promise that our staff and agents will fulfill these obligations.

WHAT INFORMATION IS COLLECTED AND HOW DO WE USE IT?

TYPES OF INFORMATION COLLECTED

We will ask you for personal information that is necessary for us to successfully provide you with our services. If you do not provide us with this personal information, we may not be able to provide our products or services to you.

We may collect the following types of information (which may or may not be personal information):

Account information: Information related to your Mi account and the accounts you share the device with.

Device information: Information about the device linked with your account. This includes version information, firmware version, name, ID, and installation location (e.g., a study room) of your device.

Network information: We may collect network-related information when your device is connected to a network. This includes current Wi-Fi connection mode (LAN or remote), IP address, the name of the connected Wi-Fi network, Wi-Fi signal strength (i.e., RSSI) and MAC address of the device.

Control commands: When you use this plugin to control your device, we will collect and transmit your control commands.

Device operations-related information: When your device is running, we may collect device operations-related information. For example, whether the device is muted or in audio mode.

Feedback: Feedback, contact information and error logs you provide us.

HOW THE PERSONAL INFORMATION IS USED

Personal information is collected in order to provide you with products and/or services as well as to ensure legal compliance on our part with applicable laws. You hereby consent that we may process and disclose personal information to our affiliated companies (which are in the communications, social media, technology and cloud businesses), Third Party Service Providers (defined below) for the purposes stated in this Privacy Policy.

We may use your personal information for the following purposes:

Providing, processing, maintaining, improving and developing our goods and/or services to you, including after-sales and customer support and for services on your device or through our websites.

Communicating with you about your device, service or any general queries, such as updates, customer inquiry support, information about our events, notices.

Analyzing and developing statistical information related to the use of our products and services so as to improve our products and services.

Storing and maintaining information about you for our business operations or legal obligations.

Here are more details on how we use your information (which may include personal information)

Connecting your device to the Mi Home app: Before the device can be operated using the Mi Home app, we need to verify the authenticity of your device by checking its factory MAC address and device ID information. To ensure stable connectivity, we may also use network information to select the best connection method for the device.

Displaying device status: Device information reported by your device allows you to remotely view the device's status so you can check the device's operating status in your home at any time.

Controlling the device: Allows you to control and adjust how the device works. For example, you can command your TV to enter or exit audio mode, adjust your TV volume, or operate your TV using the remote control feature. In order to provide you with this functionality, we will collect your device information, information needed to operate the device, and your control commands.

Collecting user feedback. The feedback that you choose to provide is extremely valuable to us, as it helps us improve the services that Xiaomi provides. In order to follow up on the feedback you have chosen to provide, Xiaomi may correspond with you using the personal information that you have provided and keep records.

DIRECT MARKETING

We may use your Mi Account ID to provide you with relevant promotional materials for products and services of Xiaomi and its partners. We will only use your personal data after we have obtained your consent or indication of no objection in accordance with local data protection laws, which may require separate explicit consent. You have the right to terminate our use of your personal data for direct marketing purposes. If you no longer wish to receive certain types of email communication, you can notify us by sending an e-mail to privacy@xiaomi.com. We will not transfer your personal data to our business partners for direct marketing.

COOKIES AND OTHER TECHNOLOGIES (ONLY WHEN BROWSING WWW.MI.COM)

What type of information is collected and how is it used? Technologies such as cookies, tags, and scripts are used by Xiaomi and our Third Party Service Providers. These technologies are used in analyzing trends, administering the site, tracking users' movements around the website and to gather demographic information about our user base as a whole. We may receive reports based on the use of these technologies by these companies on an individual as well as aggregated basis.

Log Files: Like most websites, we collect specific information and store it in the log files. This information may include Internet protocol (IP) addresses, browser type, Internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and/or clickstream data. We do not link this automatically collected data to other information we gather about you.

Advertising: We partner with our Third Party Service Providers to either display advertising on our website or to manage our advertising on other sites. Our Third Party Service Provider may use technologies such as cookies to gather information about your activities on this site and other sites in order to provide you advertising based upon your browsing activities and interests. Mobile Analytics: Within some of our mobile applications we use mobile analytics software to allow us to better understand the functionality of our Mobile Software on your phone. This software may record information such as how often you use the application, the events that occur within the application, aggregated usage, performance data, and where crashes occur within the application. We do not link the information we store within the analytics software to any personal information you submit within the mobile application.

Local Storage – HTML5/Flash: We use Local Storage Objects (LSOs) such as HTML5 or Flash to store content and preferences. Third parties with whom we partner to provide certain features on our Sites or to display advertising based upon your web browsing activity also use HTML5 or Flash cookies to collect and store information. Various browsers may offer their own management tool for removing HTML5 LSOs.

WHO DO WE SHARE YOUR INFORMATION WITH?

We do not sell any personal information to third parties.

We may disclose your personal information on occasion to third parties (as described below) in order to provide the products or services that you have requested.

We may disclose your personal information to third-party service providers and affiliated companies as described below. In each scenario listed below, you can rest assured that Xiaomi will only share your personal information according to what you have personally authorized. You should understand that when Xiaomi and third-party service providers are sharing your personal information in each scenario listed below that Xiaomi shall stipulate practices and obligations of such third parties via contracts to comply with applicable local data protection laws. Xiaomi shall also use contracts to ensure that third-party service providers comply with standards of privacy rights applicable to them in your jurisdiction.

SHARING WITH OUR GROUP AND THIRD PARTY SERVICE PROVIDERS

In order to operate successfully and provide you with the full functionality of our products and services, we may occasionally disclose your personal information to other Xiaomi affiliates or with our third-party service providers (our mailing centers, delivery services providers, telecommunications companies, data centers, data storage facilities, customer service providers, advertising and promotional service providers, and agents representing Xiaomi). These kinds of third-party service providers may process your personal information as a representative of Xiaomi, or they may fall into one or several of the categories listed above. SHARING WITH OUR GROUP'S ECOSYSTEM COMPANIES

Xiaomi cooperates with a group of cool companies which together form the Mi Ecosystem. The Mi Ecosystem companies are independent entities, invested and incubated by Xiaomi, and are experts in their fields. Xiaomi may disclose your personal data to Xiaomi or other Mi Ecosystem companies so as to provide you with and improve the exciting products and services (both hardware and software) from the Mi Ecosystem companies. Some of these products and services will still be under the Xiaomi brand, while others may use their own brands. From time to time, Mi Ecosystem companies may share data with Xiaomi relating to products and services under the Xiaomi brand in order to provide software and hardware services and offer better features and an improved user experience. If Xiaomi is involved in any merger, acquisition, or sells all or part of its assets, we will use emails and/or eye-catching notices on our websites to inform you any changes of ownership or use of your personal information, and any options you may have regarding your personal information.

SHARING WITH OTHERS

Xiaomi may disclose your personal information to others without further consent when it is required by law.

INFORMATION NOT REQUIRING CONSENT

We may share anonymized information and statistics in aggregate form with third parties for business purposes, for example with advertisers on our website, we may share them trends about the general use of our services, such as the number of customers in certain demographic groups who purchased certain products or who carried out certain transactions.

For the avoidance of doubt, Xiaomi may collect, use or disclose your personal information without your consent if it is, and only to the extent it is, allowed explicitly under local data protection laws. Such disclosure may be brought about by the necessity to protect our rights, ensure your safety and that of other people, and comply with the requirements of the local government to facilitate the investigations of illegal activities.

SECURITY SAFEGUARDS

XIAOMI'S SECURITY MEASURES

We are committed to keeping your personal information secure. In order to prevent unauthorized access, disclosure, or other such risks, we have implemented reasonable physical, electronic, and management-related measures to protect the information we collect from your products and Xiaomi websites. We will take all reasonable measures to protect your personal information.

Your personal information is all stored on safe servers and is protected in controlled facilities. We will classify your data based on importance and sensitivity and ensure that your personal data possesses the highest level of security. We will ensure that staff and third-party service providers which access such information to help provide you with services and products shoulder the strict contractual obligation of maintaining confidentiality. If they fail to fulfill such obligations, then we will impose disciplinary actions or terminate cooperation. In short, we will periodically review our information collection, storage, and handing practices, including physical security measures, to prevent any unauthorized access and use.

We will take all possible measures to protect your personal information. You should, however, be aware that the Internet is not always secure. Because of this, we cannot guarantee the security or integrity of any personal information when it is being transmitted online in either direction.

WHAT YOU CAN DO

You can play your part in safeguarding your personal information by not disclosing your login password or account information to anybody unless such person is duly authorized by you.

Xiaomi cannot be held responsible for lapses in security caused by third party accesses to your personal information as a result of your failure to keep your personal information private. Notwithstanding the foregoing, you must immediately notify us if any online users access your account without permission or if any other security breaches occur.

Your assistance will help us protect the privacy of your personal information.

RETENTION POLICY

We will retain personal information (if necessary) for fulfilling the purpose for which it was collected or for complying with applicable legal requirements or permissions. As long as we can reasonably infer that a retention of personal information cannot fulfill the purpose for which it was collected, and we no longer need to retain the information for legal reasons, dispute resolution, enforcement of our agreements, or any other business-related purpose, we will cease to retain such personal information, or we will eliminate any ways in which such personal information may be associated with specific individuals.

ACCESSING OTHER FEATURES ON YOUR DEVICE

Our applications may access some features on your devices, such as Wi-Fi network status, and other features. Such information is used to allow running of those applications on your devices and your interactions with our applications. You may revoke your permissions by turning these off on the device or contacting us at privacy@xiaomi.com at any time.

YOU HAVE CONTROL OVER YOUR INFORMATION

CONTROLLING SETTINGS

Xiaomi recognizes that privacy concerns differ from person to person. Therefore, we provide examples to illustrate the ways Xiaomi provides for your choice, so as to restrict the collection, use, disclosure or processing of your personal information and control your privacy settings:

Log in to or out of your Mi Account;

Register and unregister a device;

If you have previously agreed to our using of your personal information for the aforementioned purposes, you may change your mind at any time by writing or emailing us at privacy@xiaomi.com.

ACCESSING, UPDATING, OR CORRECTING YOUR PERSONAL INFORMATION

You have the right to request access to and/or correction of any other personal information that we hold about you. When you update your personal information, you will be asked to verify your identity before your request is processed. Once we have a sufficient amount of information, we will be able to process your request to either access or make corrections to personal information. We will respond to your request within the period specified by applicable data protection laws.

We normally provide such services for free but reserve the right to charge a reasonable fee for your data access request.

For details relating to the personal information in your Mi account, you may also access and change them at http://account.mi.com or by logging into your account on your device.

WITHDRAWAL OF CONSENT

You may withdraw your consent for the collection, use and/or disclosure of your personal information in our possession or control by submitting a request. This can be done in the plugin by going to Settings > Legal. We will process your request within a reasonable time frame from the time the request was made and thereafter will not collect, use, and/or disclose your personal information in accordance with your request.

Please note that your withdrawal of consent could result in certain legal consequences. Depending on the extent of your withdrawal of consent for us to process your personal information, it may mean that you will not be able to enjoy Xiaomi's products and services.

TRANSFER OF PERSONAL INFORMATION OUTSIDE OF YOUR JURISDICTION

To the extent that we may need to transfer personal information outside of your jurisdiction, whether to our affiliated companies (which are in the communications, social media, technology and cloud businesses) or Third Party Service Providers, we shall do so in accordance with the applicable laws. In particular, we will ensure that all transfers will be in accordance with requirements under your applicable local data protection laws by putting in place appropriate safeguards.

Currently, Xiaomi has data centers in China, the United States, Germany, India, Russia, and Singapore. These overseas jurisdictions may or may not have in place data protection laws which are substantially similar to that in your home jurisdiction. We may transfer to and store your personal information at our overseas facilities. However, this does not change any of our commitments to safeguard your personal information in accordance with this Privacy Policy.

MISCELLANEOUS

MINORS

We believe that it is the responsibility of parents to supervise their children when using our products and services. Nevertheless, it is our policy not to require personal information from minors or offer to send any promotional materials to persons in that category.

Xiaomi does not seek or intend to seek to receive any personal information from minors. If parents or guardians have reason to believe that a minor has submitted personal information to Xiaomi without their prior consent, they should contact us to ensure that such personal information is removed and that subscriptions the minor may have for any applicable Xiaomi services are canceled.

ORDER OF PRECEDENCE

If you have agreed to our applicable User Agreements, in the event of inconsistency between such User Agreements and this Privacy Policy, such User Agreements shall prevail.

UPDATES TO THE PRIVACY POLICY

We keep our Privacy Policy under regular review and may update this privacy policy to reflect changes to our information practices. If we make material changes to our Privacy Policy, we will notify you by email (sent to the email address specified in your account) or post the changes on all the Xiaomi websites or notify you through your mobile device, so that you may be aware of the information we collect and how we use it. Such changes to our Privacy Policy shall apply from the effective date as set out in the notice or on the website. We encourage you to periodically review this page for the latest information on our privacy practices. Your continued use of products and services on the websites, mobile phones and/or any other device will be taken as acceptance of the updated Privacy Policy. We will seek consent from you again before we collect more personal information from you or when we wish to use or disclose your personal information for new purposes.

DO I HAVE TO AGREE TO ANY THIRD PARTY TERMS AND CONDITIONS?

Our Privacy Policy does not apply to products and services offered by a third party. Xiaomi products and services may include third parties' products, services, and links to third parties' websites. Third parties may collect your information when you use such products or services. For this reason, we strongly suggest that you read the third party's privacy policy just as you have taken the time to read ours. We are not responsible for and cannot control how third parties use personal information that they collect from you. Our Privacy Policy does not apply to other websites that are linked via our services.
